Severe burns compensation – who can claim?

You could be entitled to burns injury compensation if you have suffered any type of burn or scold in an accident that was not your fault. A burn is damage to the skin caused by dry heat (e.g. fire). A scold is damage to the skin caused by wet heat (e.g. hot water, steam).

Burns injury compensation may be available if you have experienced any of the following:

  • Burns or scolds that cause blisters
  • Chemical or electrical burns or scolds
  • Large burns or scolds bigger than your hand
  • Burns or scolds that cause whiteness or charring of the skin

If your burns injury was caused by fire or contact with a hazardous chemical, you may have also developed symptoms associated with smoke inhalation such as shortness of breath and breathing difficulties. We will ensure that all of your symptoms are taken into account when assessing your personal injury compensation claim.

Types of burns injury

Burns are typically graded on a three tier system:

First Degree Burns

First degree burns affect the upper layer of the skin (the epidermis), resulting in reddened skin that is painful or sensitive to the touch.

Second Degree Burns

Second degree burns affect the upper and middle layers of the skin (the epidermis and the dermis), resulting in blistering and severe pain.

Third Degree Burns

There is irreversible damage to all three layers of the skin. There is no sensation in the affected area. Amputation may be required.
