£1,900 Compensation Secured for Holiday Illness

The travel law team here at Hampson Hughes Solicitors were recently instructed by a client whose dream getaway to Mexico was plagued by holiday illness.

Our client booked a week long stay at the 3* Riu Yucatan hotel in the Playa del Carmen resort of Mexico in January 2016. The holiday was booked as an all-inclusive package deal with tour operators TUI.

Poor food & hygiene standards

Upon the Claimant’s immediate arrival at the hotel there was strong smell of sewage, both in the hotel itself and the surrounding areas.

They also report that throughout their stay at the Riu Yucatan hotel, they noticed a number of issues relating to poor food and hygiene practices, particularly with regards to the buffet style food service available. Our client reports:

• Food was left uncovered for extended periods of time
• Food appeared reheated and was served at incorrect temperatures
• Staff members handling food did not appear to wear gloves when doing so

According to the claimant most dishes served in the restaurant were covered in a thick sauce and so it was difficult to know if they contained meat, and, if so, if the meat was cooked correctly. At one evening meal our client was about to tuck into a dish when they realised that it contained raw meat.

Holiday illness

On the final day of their holiday, our client began to suffer from symptoms related to food poisoning. Their symptoms included abdominal cramps, nausea, vomiting and fatigue, as well as diarrhoea containing blood.

The claimant self medicated while abroad with Imodium and pain killers purchased from a local pharmacy. Upon their return to the UK, our client reports having to visit his GP on more than one occasion due to their holiday illness. They also claim that a year on from their trip to Mexico, their health has not returned to how it was prior to the holiday.

Successful outcome

Liability was admitted by TUI and an out of court settlement was agreed on.

£2,000 in Damages Secured for Illness Abroad

Our expert Holiday Illness team recently took instruction for a client after their luxury Christmas holiday to Mexico was ruined by food poisoning.

The Claimant booked a two week holiday at the Riu Palace Peninsula Hotel in Mexico back in December 2013. The holiday was booked as an all-inclusive package deal with popular tour operator TUI.

Smell of sewage around hotel

According to our client, upon arrival at the hotel it was apparent that hygiene standards at the hotel were not to an acceptable standard.

Our client reports a strong smell of sewage around the hotel grounds and claims that the bathroom in their hotel room was dirty and in a poor state of repair. The Claimant added that water from the taps was green in colour and had a sewage type smell coming from them.

Poor food hygiene in hotel restaurant

The Claimant similarly reports that food hygiene standards and practices at the hotel restaurant were also very poor. According to our client, hot food was often added to trays of cooler food of the same type and certain dishes appeared to be reheated. They added that restaurant staff did not appear to monitor the temperature of the food at any time.

The Claimant reports that restaurant staff did not wear gloves when handling food. Food was also left uncovered for prolonged periods of time, exposed to the wild birds seen around the eating areas. Furthermore, the drinks served appeared to be watered down and contained ice which was believed to have been made with local tap water.

Christmas ruined

Unfortunately on Christmas Day, around a week into the holiday, our client began to feel unwell. They suffered with various symptoms associated with food poisoning, including:

• Diarrhoea
• Abdominal cramps
• Fatigue
• Nausea

Prior to experiencing their symptoms, our client had not eaten or drank anywhere else other than at the various restaurants within the hotel complex. With this in mind, along with the extremely poor food and hygiene standards at the Rui Palace Peninsula, our client avers their symptoms were a result of eating the food at the hotel.

The Claimant reports that TUI’s holiday representative at the Rui Palace Peninsula was only available in the mornings. As a result, they self-medicated with Imodium and other medication purchased from a local pharmacy.

Outcome

Liability was admitted by TUI and an out of court settlement was agreed on.

Mexican Getaway Ruined by Gastric Illness

Our dedicated Travel Law team were recently instructed by a client after they contracted a severe gastric holiday illness on a luxury holiday to Mexico.

Our client booked a two weeks stay at the 5* Ocean Maya Royale, in the Playa del Carmen resort of Mexico.

Poor food & hygiene standards

As the holiday was booked as an all-inclusive package deal with Thomson Holidays, our client ate all food and drink at the hotel. According to the claimant, the food and hygiene standards in the hotel’s restaurant and eating areas were not up to a 5* standard at all.

Our client reports food being recycled for use in other meals and the temperature of the buffet type food available was not monitored by staff at all, meaning that hot food was often added to trays containing cooler food. The claimant also reports that ice in the drinks was made using local tap water.

Severe gastric illness

Unfortunately, after our client ate at the restaurant a number of times, they began to experience severe gastric illness – the symptoms of which included severe diarrhoea, abdominal cramps, vomiting, fatigue and nausea.

Our client avers that there illness was a direct result of the poor food and hygiene standards at the Ocean Maya Royale.

Mexico Family Wedding Ruined by Holiday Illness

Our expert Travel Law team was recently instructed by a client, after their trip to Mexico for a family wedding was ruined when they contracted holiday illness.

Our client booked a fourteen night stay at the Riu Yucatan in Playacar, Mexico with tour operators TUI. The holiday was booked to attend a family member’s wedding. However, after falling severely ill, they claim that the trip was completely ruined.

Holiday illness – symptoms

The claimant’s holiday illness symptoms included severe diarrhoea, diarrhoea with blood, nausea, temperature, fatigue and stomach cramps. They sought medication for their symptoms which remain ongoing.

Our client avers that their holiday illness occurred as a result of the poor standard of food and hygiene at the Riu Yucatan, particularly within the hotel restaurant.

Poor food and hygiene standards

They noted that food was under-cooked in hotel restaurant, wasn’t served at the right temperature and appeared reheated. Our client claims that food was left out uncovered for prolonged periods of time and therefore exposed to flies, insects and monkeys that could be seen around the eating areas.

Successful outcome

Dream Holiday to Mexico Plagued by Holiday Illness

Our expanding travel law team here at Hampson Hughes Solicitors were recently instructed by a young couple whose dream holiday to Mexico was plagued by holiday illness.

Dream holiday ruined

Miss England and her partner, Mr Gardener, booked a two week stay at the Riu Cancun hotel in Cancun, Mexico for July 2015. The couple had booked the dream holiday almost a year in advance with tour operators TUI.

Miss England said:

‘We couldn’t wait for the holiday to Mexico; it was something that we both really looked forward to.’

Poor Hygiene Standards

However, not long after arriving at the hotel, the pair noticed numerous instances of poor hygiene standards.

Poor levels of food hygiene

According to Miss England, the level of hygiene within the hotel restaurant was particularly poor. Food was reportedly undercooked, appeared reheated and was often served at the incorrect temperature. Furthermore, the couple witnessed food left out and uncovered for prolonged periods of time. Miss England said they found this particularly alarming, due to the high number of birds in and around eating areas.

According to our clients, the restaurant itself also appeared unclean and the food that was available was of a poor standard.

‘It was awful’

A few days into the holiday, both Miss England and Mr Gardener became very unwell. The pair suffered various symptoms, including stomach cramps, diarrhoea, severe diarrhoea, nausea, vomiting, temperature and fatigue. Miss England added:

‘It was awful. The holiday which we had l worked so hard for and looked forward to – for almost a year -was completely ruined. And it wasn’t just us; we overheard other guests at the hotel complaining of sickness too.’

£4,700 in Compensation Secured

Holiday Illness: Couple Demand Answers after Husband Contracts Sepsis

A man has been left unable to work again after contracting sepsis at a Mexican hotel on what was supposed to be a ‘dream holiday’.

Severe gastric illness

Clive Roberts, 62, ended up in intensive care after he and his wife Caroline returned from their holiday at the luxury Barceló Maya Tropical resort. On their first day back in the UK, Mr Roberts developed a severe gastric illness, suffering with symptoms such as vomiting, a fever and diarrhoea, whilst at his job as a scaffolder.

After a visit to his GP, Mr Roberts was advised to go straight to A&E as his symptoms were so severe. Upon his arrival at Worthing Hospital’s A&E, he was admitted to an intensive care unit (ICU) where he was diagnosed with Sepsis and Haemolytic Uremic Syndrome (HUS). HUS is a severe and often life-threatening complication that occurs in about 10% of those infected with E.coli and can often lead to kidney failure.

The trip to Mexico was supposed to be a celebration of Mrs Roberts’ 60th birthday; however the couple now demand answers, after their luxury holiday ended in a stay in ICU. They have sought legal advice and are urging anyone suffering with similar symptoms after staying at the Barceló Maya Tropical resort.

Health & hygiene concerns

According to Mr Roberts, the couple have a number of concerns regarding the health and hygiene standards at the resort. They claim they often saw birds pecking at uncovered food in the hotel restaurants, as well as food that was supposed to be kept chilled being served at room temperature.

Mr Roberts said:

‘This was supposed to be an enjoyable holiday to celebrate Caroline’s 60th birthday in style.

‘The hotel really wasn’t up to the standards we had expected and we were left disappointed.

‘To fall seriously ill immediately after coming back to the UK and end up spending three weeks in hospital has meant the memories of Caroline’s 60th birthday have been ruined forever.

‘We want to know what caused me to fall so ill and that the hygiene concerns will be looked into, so that other people will not go through the ordeal we have endured.’

A spokesman for Barceloa has provided the following statement:

‘Mr and Mrs Roberts stayed at the Barcelo Maya Hotel in Mexico from March 3 to 17, 2015.

‘We read in the MailOnline that he was diagnosed with sepsis after he returned home to England.

‘We hope that he has made a full recovery. Mr and Mrs Roberts have not been in touch with the hotel since their stay in March 2015.

‘The hotel adheres to all health and safety inspections. We take the wellbeing of our guests extremely seriously and will conduct every necessary investigation.’
