Our travel law team were recently instructed by a client who contracted food poisoning whilst on holiday in the Dominican Republic.

Our client had booked to stay at the 5* Chic by Royalton, Punta Cana for two weeks. The holiday was booked as an all-inclusive package with tour operators Thomas Cook.

Just a few days into their holiday however, the claimant began to suffer from various symptoms, including stomach cramps, headaches and severe diarrhoea. Our client’s symptoms lasted a fortnight and understandably, they could not thoroughly enjoy their luxury break.

The claimant avers that their symptoms were a direct result of the poor food and hygiene standards at the hotel restaurant.

According to our client, food served in the hotel restaurant appeared under-cooked, wasn’t served at the correct temperature, often appeared to have been reheated and was left out for long periods of time without being covered by a steel bain-marie.

Our client also claims that suitable refrigeration was not provided and that staff members handling food did not wear gloves. They also claim that cutlery and crockery provided was dirty and that the eating areas were infested with insects and flies.

Holidaymaker Receives £3,000 for Food Poisoning Abroad

The Travel Law team here at Hampson Hughes Solicitors were recently instructed by a client who fell severely ill whilst on a luxury holiday in the Dominican Republic.

5* Holiday Ruined

Daniel booked a two week stay at the 5* Grand Palladium Palace Resort Spa & Casino in the Punta Cana area with tour operators Thomson.

Unfortunately, not long into his stay at the 5* resort, he began to suffer symptoms associated with bacterial gastroenteritis or food poisoning. Daniel complained of suffering stomach cramps, diarrhoea and vomiting, which lasted for around thirteen days.

Poor Standards in Restaurant

As the luxury holiday was booked as an all-inclusive package, Daniel ate at the restaurants within the hotel throughout his stay there. However, according to our client, the food and hygiene levels within those restaurants were not of a five star standard.

Daniel claims that food was under-cooked, appeared to have been reheated, was left out for long periods of time and that cutlery and crockery provided to guests was dirty.

Complaint Ignored

On one occasion, Daniel complained to a waiter in the hotel restaurant that the chicken he had served was raw. According to our client, the waiter took this back to the kitchen, only to return with another portion of raw chicken.

Whilst at the hotel, Daniel reported his illness to hotel reception. He did not visit the hotel doctor due to the expense, instead choosing to self-medicate.

Over £6,000 Secured for Holiday Illness in Egypt

Family holiday ruined

Katherine, Michael and Thomas booked a week long stay at the Steigenberger Aqua Magic Hotel in Hurghada, Egypt with tour operators Thomas Cook.

However, not long into their holiday, all three began to suffer symptoms associated with food poisoning.

Our clients complained of suffering stomach cramps, diarrhoea, temperature and feelings of fatigue for a total of fourteen days. Katherine, Michael and Thomas all ate at the hotel restaurant as their holiday was booked as an all-inclusive package. They aver that their symptoms were caused by the poor food and hygiene standards at the Steigenberger Aqua Magic Hotel.

‘Dirty’

During their stay, our clients claim that food served in the restaurant was under-cooked, appeared to have been reheated and was left out for long periods of time. All three also witnessed flies and insects around the hotel’s eating areas and claim that cutlery and crockery provided was also dirty.

Overall, our clients claim that the food and the restaurant itself was of a very poor standard.

Holidaymaker Falls Severely Ill in Cuba

We were recently instructed by a client who suffered food poisoning whilst on a luxury Cuban holiday.

Tropical Island Holiday

Stephen booked to stay at the all-inclusive 4* Sol Cayo Coco, situated on the tropical island of Cayo Coco, Cuba, for two weeks. The holiday was booked as a package deal through tour operators Thomas Cook.

However, after arriving at the hotel it was immediately obvious to our client that levels of hygiene within the hotel were not at an acceptable standard.

Poor hygiene standards

Stephen claims there was a strong smell of sewage that was noticeable throughout the hotel, faeces was found on the floor and the majority of toilets within the hotel were blocked and overflowing.

Stephen also claims that his room was not cleaned regularly and that towels/linens were not changed during his stay. Furthermore, appliances provided in his hotel room, such as the shower, were not in good working condition.

Hotel restaurant – ‘dirty’

As our client had booked an all-inclusive stay at the Sol Cayo Coco, he ate at the hotel restaurant each night during his holiday. According to Stephen, this was not a pleasant experience. Food served to guests was often left out uncovered for long periods of time, food was under-cooked and at times appeared to have been reheated.

Overall the standard of food available at the hotel was poor, as was the choice of dishes available. Furthermore, our client claims that the restaurant itself appeared ‘dirty’ and was infested with flies and insects. Stephen adds that the cutlery and crockery provided to guests also appeared unclean.

Symptoms

Unfortunately, just a few days into the holiday Stephen began to feel ill. He suffered various debilitating symptoms including vomiting and severe diarrhoea, as well as stomach cramps, nausea, fatigue and a high temperature.

Our client avers that his symptoms, which lasted a total of 20 days, were caused by the poor levels of hygiene at the Sol Cayo Coco.

£7,500 Holiday Illness Compensation Secured

Our Travel Law team were recently instructed by a mother and son after they became ill with food poisoning on a family holiday to Mexico.

Our client, along with her husband and son, booked a fifteen night stay at the Bahia Principe Akumal in Riviera Maya, Mexico, in August last year. The holiday was booked as an all-inclusive package through tour operator TUI.

Three days into the holiday our client began to feel unwell. She suffered with stomach cramps and severe diarrhoea that lasted a total of twenty one days.

Around a week into their family holiday, the son started to suffer with similar symptoms, these lasted a total of seventeen days.

Our clients’ symptoms were reported to a hotel representative, medical attention and medication were also sought from the onsite medical centre at the Bahia Principe Akumal. Upon their return to the UK, both mother and son sought advice from their GP and were prescribed antibiotics for their illness.

The claimants aver that their illness occurred as a result of eating the food at the restaurant within the hotel.

Our clients noted that buffet style food served was under-cooked on more than one occasion. They also claim that food was not served at the correct temperature, often appeared to have been reheated and was left out for long periods of time.

Our client also believes that when she requested bottled water, she was given tap water as it was not served in a bottle and that ice served in drinks was made from tap water.

Holiday to Egypt Ruined by Poor Hygiene at Hotel

Family’s Holiday to Tunisia Ruined

The travel law team here at Hampson Hughes Solicitors were recently instructed by a client after her family holiday was ruined by holiday illness.

Sahara Beach Hotel

Miss Hunter booked a fourteen night stay at the Sahara Beach Resort Hotel, in Skanes, Tunisia along with five others, including her partner and children. The trip was booked as an all-inclusive package holiday, through tour operator Thomas Cook.

Around three days into her stay at the Sahara Beach Resort, Miss Hunter began to feel unwell. She suffered with holiday illness symptoms including severe diarrhoea, headaches and stomach cramps. Our client avers that her illness, which lasted a total of six days, occurred as a result of eating the food at the restaurant within the hotel.

Poor food & hygiene standards

According to Miss Hunter food appeared under-cooked, reheated and was left uncovered for long periods of time. Miss Hunter also claims that the buffet style salad available appeared to have been washed with tap water.

Our client was disappointed with the overall quality of the food, and noted that a large number of birds and insects could be seen around the eating areas of the hotel.

Miss Hunter expressed her concerns regarding the food & hygiene standards within the hotel to a representative. However, according to our client they did not seem too concerned and after attempting to sell Miss Hunter an excursion, told her to speak with hotel management.

Loss of enjoyment

Due to her holiday illness, Miss Hunter was unable to enjoy her two week stay in Tunisia with her family and even had to cancel her place on a pre-booked safari excursion.

Thomas Cook admitted liability in this case.

Mexico Family Wedding Ruined by Holiday Illness

Our expert Travel Law team was recently instructed by a client, after their trip to Mexico for a family wedding was ruined when they contracted holiday illness.

Our client booked a fourteen night stay at the Riu Yucatan in Playacar, Mexico with tour operators TUI. The holiday was booked to attend a family member’s wedding. However, after falling severely ill, they claim that the trip was completely ruined.

Holiday illness – symptoms

The claimant’s holiday illness symptoms included severe diarrhoea, diarrhoea with blood, nausea, temperature, fatigue and stomach cramps. They sought medication for their symptoms which remain ongoing.

Our client avers that their holiday illness occurred as a result of the poor standard of food and hygiene at the Riu Yucatan, particularly within the hotel restaurant.

Poor food and hygiene standards

They noted that food was under-cooked in hotel restaurant, wasn’t served at the right temperature and appeared reheated. Our client claims that food was left out uncovered for prolonged periods of time and therefore exposed to flies, insects and monkeys that could be seen around the eating areas.

Successful outcome

Holidaymaker Contracts Food Poisoning in Turkey

Our travel law team were recently instructed by a client who contracted infective gastroenteritis whilst on holiday in Turkey.

Robert Collins booked a week long stay at the Club Jullian Hotel in Marmaris, Turkey in October last year. The holiday was booked as an all-inclusive package deal with tour operators Thomas Cook.

Symptoms related to food poisoning

Unfortunately, just two days into his holiday, Mr Collins began to feel unwell. He suffered from vomiting, severe diarrhoea, nausea, stomach cramps and a temperature for the remainder of his holiday. Due to his symptoms, Mr Collins needed to be close to a toilet at all times and so for five days of his holiday, he stayed in and around his room and the hotel itself. Medication was purchased at a local pharmacy to help relieve his symptoms.

Poor hygiene at hotel

According to our client, the hygiene standards at the hotel were very poor, particularly in relation to the food.

Mr Collins claims that food was under-cooked in the hotel restaurant and was not served at the right temperature. Food appeared reheated and was left out for long periods of time and was therefor exposed to the large number of flies seen in and around eating areas.

Our client’s symptoms did not improve upon his return to the UK and he took two weeks sick leave from his place of employment. Mr Collins also sought medical attention from his GP in the UK, after developing a sore throat as a direct result of repeated vomiting.

Holiday to Turkey Ruined by Food Poisoning

Our team of expert Travel Law solicitors recently secured compensation for a client, after her 7 day holiday to Turkey was ruined by food poisoning.

Veronika Piskorova booked to stay at the Crystal Hotel in Bodrum, Turkey, as an all-inclusive package holiday through hotel operators Olympic Holidays in August 2015.

Just three days into her stay at the Crystal Hotel, Miss Piskorova began to feel unwell. She suffered symptoms including stomach cramps, diarrhoea, nausea and vomiting after eating at the hotel restaurant.

Miss Piskorova noted various issues relating to poor food and hygiene standards in the restaurant. Food was left uncovered for long periods of time, as well as appearing under cooked and reheated. Miss Piskorova claims that food was often served at the incorrect temperature and there seemed to be no suitable refrigeration in place, with salads being served warm.
