Holidaymaker Receives £3,000 for Food Poisoning Abroad

The Travel Law team here at Hampson Hughes Solicitors were recently instructed by a client who fell severely ill whilst on a luxury holiday in the Dominican Republic.

5* Holiday Ruined

Daniel booked a two week stay at the 5* Grand Palladium Palace Resort Spa & Casino in the Punta Cana area with tour operators Thomson.

Unfortunately, not long into his stay at the 5* resort, he began to suffer symptoms associated with bacterial gastroenteritis or food poisoning. Daniel complained of suffering stomach cramps, diarrhoea and vomiting, which lasted for around thirteen days.

Poor Standards in Restaurant

As the luxury holiday was booked as an all-inclusive package, Daniel ate at the restaurants within the hotel throughout his stay there. However, according to our client, the food and hygiene levels within those restaurants were not of a five star standard.

Daniel claims that food was under-cooked, appeared to have been reheated, was left out for long periods of time and that cutlery and crockery provided to guests was dirty.

Complaint Ignored

On one occasion, Daniel complained to a waiter in the hotel restaurant that the chicken he had served was raw. According to our client, the waiter took this back to the kitchen, only to return with another portion of raw chicken.

Whilst at the hotel, Daniel reported his illness to hotel reception. He did not visit the hotel doctor due to the expense, instead choosing to self-medicate.
