John fell while walking along Severn Road in Wigan. Sadly, the public pavement had been gritted following cold and icy weather. As such it presented a serious trip hazard.
In the accident John suffered broken ribs to the left side of his body. This led to excruciating pain and breathing difficulties that lasted four months. He was also unable to perform all of his duties as a Grounds Maintenance Officer as his ability to lift heavy items was restricted.
The defendant, Wigan Borough Council, originally denied liability as they stated that gritting had taken place. Unfortunately, the case was made more difficult by the fact that there were no witnesses to the accident. In spite of this we chose to proceed with the case and issued court proceedings against the council authority. Wigan Borough Council subsequently made an offer to settle the case before it went to court awarding the client £2,850.
