Client Involved in Road Traffic Accident Receives £3,860

Incident
At the time of the incident, Mr Fitzsimmons was travelling along Wakefield Road when the Defendant, who was driving a Ford KA, negligently changed lanes when it was unsafe to do so and collided with the offside of our client’s vehicle.
Whiplash injuries
As a result of the accident, Mr Fitzsimmons’ vehicle sustained significant damage and he suffered whiplash injuries to his neck, back and shoulders. Our client also suffered travel anxiety and his usual activities of shopping, swimming and DIY were all restricted. Mr Fitzsimmons’ symptoms persisted for a number of months following the collision.
The main issues with this file were ensuring our client received the full amount for his damages. The Defendants proposed a 50/50 split offer directly to our client’s insurers, which they were considering accepting. With this type of accident, it is common for there to be a split as it is often one person’s word against another.
However, following discussions with Mr Fitzsimmons we believed him to be an extremely credible witness, and hence we believed this to be a poor offer. We therefore requested that our client’s insurers reject any split in liability so as to not prejudice our position.
Successful outcome
The Defendants were reluctant to admit full liability, even following our Part 36 offer of settlement, however once we suggested instigating court proceedings they agreed to settle the matter in full prior to any trial.
