New Drivers Using Phones Could Lose Licence

In an effort to reduce the number of road traffic accidents in the UK, new penalties for motorists who use their phones while at the wheel will double.

New rules

As of 1 March 2017, penalty points for individuals using a mobile while driving will double to 6, while fines will rise to £200.

Under the new rules, drivers caught using their phones in the first two years of passing their test will have their licences revoked. If a new driver accrues 6 points on their licence within the first two years, their licence is revoked and they must retake both their practical and theory.

The new rules for England, Scotland and Wales come after 22 people were killed and 99 more were seriously injured in accidents where the driver was on their phone in 2015 (the latest year for which figures are available).

Police ‘crackdown’

Police forces have also launched a week-long crackdown, with more patrols and an “increased focus” on stopping people using their phones while driving.

The government said it hoped this penalty system would act as a strong deterrent to what motoring organisations are now calling an “epidemic” on the roads.

The transport secretary, Chris Grayling, said:

“Our message is simple and clear: do not get distracted by your mobile phone while driving. It may seem innocent, but holding and using your phone at the wheel risks serious injury and even death to yourself and other road users.

“Doubling penalties will act as a strong deterrent to motorists tempted to pick up their phone while driving and will also mean repeat offenders could find themselves banned from our roads if they are caught twice.

“Everyone has a part to play in encouraging their family and friends not to use their phones while driving – it is as inexcusable as drink driving.”

£1,400 Compensation Awarded for Whiplash

Incident

Our client, Mr Fitzsimons, was travelling home from work at the time of the incident. There was heavy traffic as he approached the M6 Junction near Knutsford, and so our client began to break.

Driver Arrested after Seven Pedestrians are Injured

A man has been arrested on suspicion of causing serious injury by dangerous driving after a road traffic accident, in which he drove his Ferrari into a group of teenagers.

The incident occurred in South London on Monday morning.

5 of the teenagers were treated in hospital for minor injuries, while two others – a girl, 16, and boy, 17 – remain in hospital. According to the Metropolitan Police their injuries are not thought to be serious.

Emergency services, including London’s Air Ambulance, attended the scene in Battersea and road closures were put in place.

The driver, a 35 year old male, was arrested by police after stopping at the scene and he remains in custody in West London.

New Life Sentence for Death by Dangerous Driving

In plans to be put forward by the Ministry of Justice, those who cause death by dangerous driving could be handed life sentences.

New sentences proposed

Offenders who cause death whilst using a mobile phone, street racing or speeding will be handed the same sentence as those charged with manslaughter.

Furthermore, careless drivers who kill – those under the influence of drink or drugs – may also be faced with a life sentence. Currently the sentence for such an offence is limited to a 14 year prison sentence.

Justice Minister Sam Gyimah said:

“Killer drivers ruin lives. Their actions cause immeasurable pain to families, who must endure tragic, unnecessary losses. While impossible to compensate for the death of a loved one, we are determined to make sure the punishment fits the crime.”

A consultation by the Ministry of Justice will ask for views on whether the current maximum sentences should be increased.

The proposed move would see the maximum sentence for causing death by dangerous or careless driving increase from 14 years to life. There would also be a new offence for causing serious injury by careless driving, with a maximum sentence of three years. The current minimum driving ban for those who are convicted of causing death by dangerous/careless driving is also set to be increased.

The department say the consultation ‘delivers on the government’s pledge to consider the sentencing powers available to the courts for the most serious driving offences’. This comes after a total of 122 people were convicted of causing death by dangerous driving in 2015 and a further 21 sentenced for causing death by careless driving whilst under the influence.

Car Park Accidents on the Rise Due to Larger Cars

According to a recent study, the increase in car sizes over recent years has resulted in more car park accidents and demands for larger parking spaces.

Larger vehicles vs small spaces

Popular vehicles such as the Mercedes-Benz GL-Class and the Audi Q7 measure 5 meters in length and just less than 2 meters in width, whereas the average parking space is 4.8 meters long and 2.4 meters wide.

Smaller cars are seemingly increasing in size year on year too. The latest Vauxhall Corsa for instance, is 16% larger today than it was 15 years ago.

35% more car park accidents

The study, produced by Accident Exchange, notes that car parking accidents now account for more than 30% of all vehicle related accidents. This equates to around 1,859 car parking accidents every day – 35% more than in 2014.

According to the study, the average repair bill for this accident type costs £2,050 – costing the UK approximately £1.4 billion a year.

NCP announce move

The largest private car park operator in the UK, National Car Parks (NCP), has announced plans to increase the size of many of its parking spaces.

However, this has sparked outrage among those who drive smaller vehicles who argue that larger parking spaces will mean fewer spaces for them.

Speaking to The Times, a spokeswoman for the NCP said:

“We are moving towards making the bays wider as we recognise that vehicles are growing in size, especially SUVs.”

However she added that the NCP also recognised that, particularly in busy car parks such as those at railway stations, there is an ‘extremely fine balance’ between the number of spaces available and bigger spaces.
