Holiday Injury Leaves Toddler Brain Damaged

Stanley Birch was on a luxury holiday with his parents at a five star resort in Bodrum, Turkey when the holiday injury took place in 2014.

Holiday injury

Stanley was lying on a sunbed when a heavy speaker fell off a nearby balcony, falling 15 meters before landing on the two year old’s head. His parent’s feared he may be dead, as he lay motionless in a pool of blood by the pool.

A doctor staying at the hotel, the Yasmin Resort in Turgutreis, picked him up and he was rushed to a nearby hospital. Staff at the Bodrum Hospital operated on Stanley for over three hours.

Severe brain damage

The two year old was left with severe brain damage after surgeons found an epidural haematoma and were required to drain excess blood off his brain. Stanley also needed 20 staples to his head and ten stiches to his face following the incident.

Now six, Stanley’s development has been affected and his parent’s say he suffers with behavioural issues as a result of his injuries. He has to attend regular monthly check ups and his brain development is closely monitored.

Holiday injury compensation from TUI

Stanley and his family are potentially now looking at a potential payout of hundreds of thousands of pounds in personal injury compensation from holiday tour operator, TUI.

Stanley’s mother, Amy, said:

‘It was horrible.

‘Stanley had just woken up, and we were by the pool a few metres from him. Then I heard this bang and everyone was screaming.

‘I turned round and saw him lying still. He was off the sun lounger, which was completely smashed. I thought he was dead.

‘He wasn’t crying, I knew something was wrong because I knew he should be crying.

‘The ambulance came and he was in and out of consciousness when they got him to the hospital.

‘He was in there for three hours where they discovered he had suffered a tear to his main artery.’

His father, Mitchell, added:

‘He is happy and doing well, and we are lucky he is alive. But no-one knows for sure if he will develop 100 percent as he should have.

‘It is very stressful thinking how what happened on that day could still change his life now.’

Thomson accepted liability last year, but it is unlikely Stanley will receive any compensation until he is at least 18. This is because professionals won’t know exactly what effect his injuries will have until he comes to key moments in his life, such as school and exams.

TUI’s response

A spokeswoman for Thomson and First Choice said:

‘We can confirm that an incident took place at the Yasmin Resort in Bodrum on 12th June 2014 and as a result a child was taken to hospital.

‘Our resort team offered every possible support and assistance at the time of and in the aftermath of the incident, conducting a full investigation to understand what happened.

‘Our Welfare Team based in the UK were also in direct contact with the customers and continued to offer the necessary support.

‘As this case is now subject to legal proceedings it would be inappropriate to comment further.’

Woman Awarded Over £4,000 Holiday Illness Compensation

A woman from Oldham has received over £4,000 in holiday illness compensation after she contracted Salmonella while in Cuba.

Holiday illness – Salmonella

Deborah Beswick and her husband travelled to the 4* Tryp Cayo Coco resort in Cuba for a two week holiday in September 2015. However after just a week at the resort, Mrs Beswick was struck with severe holiday illness. Her symptoms included vomiting, diarrhoea and stomach cramps.

Upon the couple’s return to the UK, Mrs Beswick’s holiday illness symptoms worsened. She attended an out-of-hours GP at Manchester Royal Hospital, as well as visiting her own GP, where tests revealed that she had contracted Salmonella food poisoning. Doctor’s warned Mrs Beswick that her symptoms are not due to subside until July 2017, meaning that her ‘holiday illness’ will have lasted a total of 22 months.

‘Alarming’ food and hygiene standards

Mrs Beswick avers that her holiday illness symptoms were a direct result of the ‘alarming’ food and hygiene standards and practises she witnessed at the Tryp Cayo Coco.

According to Mrs Beswick, during her stay at the 4* resort she witnessed:

• Food was left uncovered and exposed to flies
• Birds flying around the buffet restaurant
• Food that appeared to have been reheated
• Food that was reused for several meals throughout the day
• Food that was left for prolonged periods of time at room temperature

Payout

After seeking legal advice, Mrs Beswick was awarded a total of £4,700 in holiday illness compensation from tour operator Thomas Cook.

Poor Food Hygiene Standards

Unfortunately, within the first few days of his stay at the 4* hotel, Mr Field noticed that food hygiene standards were not to an acceptable standard.

Our client reports:

• Buffet Style food service which was often tepid in temperature and left uncovered for extended periods of time.

Illness Abroad

Mr Field complained of suffering symptoms including diarrhoea; stomach pains and vomiting, as well as nausea and fatigue.

Whilst in Turkey, our client sought medical attention from the hotel doctor and was taken to hospital where he was administered with an intravenous drip. Mr Field was discharged from hospital the following day.

£2,100 Secured for Holiday Illness in Egypt

Over £11,000 Awarded after Family Holiday Ruined

According to our clients, the food and hygiene standards at the hotel were very poor, particularly in the hotel restaurants.

They claim that food was not served at the right temperature, appeared reheated and was left out uncovered for long periods of time. There also did not appear to be any suitable form of refrigeration and staff did not wear gloves when handling food.

Holidaymaker Receives £3,000 for Food Poisoning Abroad

5* Holiday Ruined

Daniel booked a two week stay at the 5* Grand Palladium Palace Resort Spa & Casino in the Punta Cana area with tour operators Thomson.

Unfortunately, not long into his stay at the 5* resort, he began to suffer symptoms associated with bacterial gastroenteritis or food poisoning. Daniel complained of suffering stomach cramps, diarrhoea and vomiting, which lasted for around thirteen days.

Poor Standards in Restaurant

As the luxury holiday was booked as an all-inclusive package, Daniel ate at the restaurants within the hotel throughout his stay there. However, according to our client, the food and hygiene levels within those restaurants were not of a five star standard.

Daniel claims that food was under-cooked, appeared to have been reheated, was left out for long periods of time and that cutlery and crockery provided to guests was dirty.

Complaint Ignored

On one occasion, Daniel complained to a waiter in the hotel restaurant that the chicken he had served was raw. According to our client, the waiter took this back to the kitchen, only to return with another portion of raw chicken.

Whilst at the hotel, Daniel reported his illness to hotel reception. He did not visit the hotel doctor due to the expense, instead choosing to self-medicate.

‘Dirty’

Holidaymaker Falls Severely Ill in Cuba

We were recently instructed by a client who suffered food poisoning whilst on a luxury Cuban holiday.

Tropical Island Holiday

Stephen booked to stay at the all-inclusive 4* Sol Cayo Coco, situated on the tropical island of Cayo Coco, Cuba, for two weeks. The holiday was booked as a package deal through tour operators Thomas Cook.

However, after arriving at the hotel it was immediately obvious to our client that levels of hygiene within the hotel were not at an acceptable standard.

Poor hygiene standards

Stephen claims there was a strong smell of sewage that was noticeable throughout the hotel, faeces was found on the floor and the majority of toilets within the hotel were blocked and overflowing.

Stephen also claims that his room was not cleaned regularly and that towels/linens were not changed during his stay. Furthermore, appliances provided in his hotel room, such as the shower, were not in good working condition.

Hotel restaurant – ‘dirty’

As our client had booked an all-inclusive stay at the Sol Cayo Coco, he ate at the hotel restaurant each night during his holiday. According to Stephen, this was not a pleasant experience. Food served to guests was often left out uncovered for long periods of time, food was under-cooked and at times appeared to have been reheated.

Overall the standard of food available at the hotel was poor, as was the choice of dishes available. Furthermore, our client claims that the restaurant itself appeared ‘dirty’ and was infested with flies and insects. Stephen adds that the cutlery and crockery provided to guests also appeared unclean.

Symptoms

Unfortunately, just a few days into the holiday Stephen began to feel ill. He suffered various debilitating symptoms including vomiting and severe diarrhoea, as well as stomach cramps, nausea, fatigue and a high temperature.

Our client avers that his symptoms, which lasted a total of 20 days, were caused by the poor levels of hygiene at the Sol Cayo Coco.

£7,500 Holiday Illness Compensation Secured

Our Travel Law team were recently instructed by a mother and son after they became ill with food poisoning on a family holiday to Mexico.

Our client, along with her husband and son, booked a fifteen night stay at the Bahia Principe Akumal in Riviera Maya, Mexico, in August last year. The holiday was booked as an all-inclusive package through tour operator TUI.

Three days into the holiday our client began to feel unwell. She suffered with stomach cramps and severe diarrhoea that lasted a total of twenty one days.

Around a week into their family holiday, the son started to suffer with similar symptoms, these lasted a total of seventeen days.

Our clients’ symptoms were reported to a hotel representative, medical attention and medication were also sought from the onsite medical centre at the Bahia Principe Akumal. Upon their return to the UK, both mother and son sought advice from their GP and were prescribed antibiotics for their illness.

The claimants aver that their illness occurred as a result of eating the food at the restaurant within the hotel.

Our clients noted that buffet style food served was under-cooked on more than one occasion. They also claim that food was not served at the correct temperature, often appeared to have been reheated and was left out for long periods of time.

Our client also believes that when she requested bottled water, she was given tap water as it was not served in a bottle and that ice served in drinks was made from tap water.

Family’s Holiday to Tunisia Ruined

Miss Hunter booked a fourteen night stay at the Sahara Beach Resort Hotel, in Skanes, Tunisia along with five others, including her partner and children. The trip was booked as an all-inclusive package holiday, through tour operator Thomas Cook.

Around three days into her stay at the Sahara Beach Resort, Miss Hunter began to feel unwell. She suffered with holiday illness symptoms including severe diarrhoea, headaches and stomach cramps. Our client avers that her illness, which lasted a total of six days, occurred as a result of eating the food at the restaurant within the hotel.

Poor food & hygiene standards

According to Miss Hunter food appeared under-cooked, reheated and was left uncovered for long periods of time. Miss Hunter also claims that the buffet style salad available appeared to have been washed with tap water.

Our client was disappointed with the overall quality of the food, and noted that a large number of birds and insects could be seen around the eating areas of the hotel.

Miss Hunter expressed her concerns regarding the food & hygiene standards within the hotel to a representative. However, according to our client they did not seem too concerned and after attempting to sell Miss Hunter an excursion, told her to speak with hotel management.

Loss of enjoyment

Due to her holiday illness, Miss Hunter was unable to enjoy her two week stay in Tunisia with her family and even had to cancel her place on a pre-booked safari excursion.

Thomas Cook admitted liability in this case.
