Image of a beach in Side, Turkey

Our team of dedicated Travel Law solicitors recently took instruction from a client whose luxury holiday to Turkey was ruined by holiday illness.

Mr Field booked a two week stay at the Barut Arum Hotel in Side, Turkey with tour operators TUI UK LTD in September 2015.

Poor Food Hygiene Standards

Unfortunately, within the first few days of his stay at the 4* hotel, Mr Field noticed that food hygiene standards were not to an acceptable standard.

Our client reports:

• Buffet Style food service which was often tepid in temperature and left uncovered for extended periods of time.
• A lot of flies around the eating area
• Food appeared to be reheated
• Certain food were being recycled for use in other meals
• Members of the catering staff were not wearing gloves when handling the food products
• Hot food was being added to trays containing cooler food of the same type.
• Drinks served tasted as if they were watered down
• Ice in drinks which were believed to be made from local tap water

As Mr Field had booked the holiday as an all-inclusive package deal, he had paid in advance for the hotel to provide his daily meals. However, after a few occasions of eating here, our client began to feel unwell.

Illness Abroad

Mr Field complained of suffering symptoms including diarrhoea; stomach pains and vomiting, as well as nausea and fatigue.

Whilst in Turkey, our client sought medical attention from the hotel doctor and was taken to hospital where he was administered with an intravenous drip. Mr Field was discharged from hospital the following day.

Our expert Travel Law team managed to secure a total of £3,050 in holiday illness compensation for Mr Field

Holiday Ruined by Poor Food Hygiene Standards at Hotel

Image of uncovered buffet food

We recently took instruction from a client who was struck down with holiday illness whilst in Egypt.

4* Magic Life Sharm

Our client, Susan, stayed at the 4* Magic Life Sharm in Sharm El Sheikh, Egypt for 7 days in October 2015. The holiday was booked as an all-inclusive package deal with tour operator TUI UK.

As Susan had opted for an all-inclusive stay, the price of all of her meals and drinks were included when booking and were provided by the hotel.

However when Susan attended the restaurant for her first meal, she noticed that hygiene standards were not to an appropriate standard. Our client reports:

• Buffet style food service which was tepid in temperature
• A high number of flies and insects around the eating area
• Meat and fish products were partially cooked and appeared to be reheated
• Certain foods were often recycled for use in other meals
• The temperature of the buffet food was not monitored by staff
• Hot food was added to trays containing cooler food of the same type

Aside from the food, Susan noted that the drinks served to hotel guests appeared to be watered down and contained ice cubes, which she suspects were made using local tap water.

Severe Gastric Illness

Unfortunately our client contracted a severe gastric illness just a few days after eating at the hotel restaurant for the first time. Susan complained of suffering with symptoms including severe diarrhoea, stomach pains and vomiting, as well as feeling nauseous.

Susan’s symptoms lasted for a total of 12 days. Day to day activities were restricted whilst away, and this did not improve upon our client’s return to the UK. Overall, Susan’s week long holiday to Egypt was completely ruined.

Our team of expert Travel Law solicitors secured a total of £2,000 compensation for Susan on this occasion.

£3,800 Secured for Food Poisoning Abroad

Image of coral under the sea in Egypt

Our team of dedicated Travel Law solicitors were recently instructed by a holidaymaker who suffered such severe food poisoning whilst in Egypt that she had to be hospitalised upon her return home.

Lisa Cooper booked a week long stay at the 4* Coral Sea Water World Resort in Sharm El Sheikh, Egypt, for the end of September/beginning of October last year. The holiday was booked as an all-inclusive package deal with tour operators TUI UK.

‘Food served partially cooked’

Unfortunately for Mrs Cooper, the cleanliness of the hotel restaurant was not to an acceptable standard. The buffet style food service available was often tepid in temperature and dishes were left uncovered for extended periods of time. According to Mrs Cooper, meat and fish products were served partially cooked and appeared to have been reheated and she saw hot food food being added to trays containing cooler food of the same type. Our client suspects that with the latter in mind, certain foods were recycled for use in other meals.

Mrs Cooper also noted that kitchen and restaurant staff were not wearing gloves when handling food products, nor did staff monitor the temperature of the buffet food before it was served to guests.

Furthermore, our client reports that a high volume of flies and insects could be seen around the eating areas and the uncovered food.

Holiday illness – food poisoning

Only a few days into her stay at the Coral Sea Water World hotel, Mrs Cooper began to suffer with various symptoms related to food poisoning. Our client complained of severe diarrhoea – which often contained blood; abdominal cramps; nausea and a high temperature.

Mrs Cooper did not seek medical attention whilst in Egypt as due to the seriousness of her symptoms, she was confined to her hotel room for the latter part of the holiday. Upon Mrs Cooper’s return to the UK however, she sought advice from her GP. Our client was immediately admitted to hospital where she was administered fluids in the form of an IV drip.

While Mrs Cooper’s more serious symptoms subsided after around 5 days, the minor symptoms she suffered lasted for a total of 60 days. As a result, our client was required to take 2 months sick leave from her place of employment.

Our Travel Law team secured a total of £3,800 in holiday illness compensation for Mrs Cooper.

Commenting on her overall experience and the service provided by Hampson Hughes, Mrs Cooper said:

“Stress free from start to finish!

“Fantastic service, stress free and very organised. Would recommend Hamspon Hughes to anyone and I was kept up to date the whole way through.”

£2,400 Secured after Client Contracts Giardiasis in Turkey

Image of a hot air balloon travelling over a mountains blue sea and a small island in Oludeniz Turkey

Our Travel Law team recently secured over £2,000 for a client after they contracted the Giardiasis infection whilst on holiday in Turkey.

Lykia World Hotel

Our client booked to stay at the Lykia World Hotel in Oludeniz, Turkey. The holiday was booked as an all-inclusive package deal with tour operators Thomas Cook.

Just a few days into the holiday however, our client began to feel unwell and started to suffer with various symptoms relating to the Giardiasis infection. Symptoms suffered by our client included:

• Diarrhoea
• Fatigue
• Abdominal cramps
• Nausea
• Vomiting
• Raised Temperature
• Foul smelling burps

Gardiasis infection

Giardiasis is an infection of the digestive system caused by tiny parasites, known as Giardia intestinalis. It is usually contracted through direct contact between people, but can be spread when an infected person doesn’t wash their hands properly after going to the toilet. The parasites are then transferred on to surfaces, utensils or food. The infection can also be contracted through the consumption of contaminated water.

Our client avers that their symptoms were a direct result of the poor level of food and hygiene standards at the Lykia World Hotel. In particular, the claimant refers to an incident in which they were told by hotel staff that fruit and vegetables served were washed with local tap water, which is thought to have cause the Giardiasis infection.

Hotel restaurant – poor hygiene standards

Whilst visiting the hotel restaurant, the claimant noticed numerous worrying hygiene issues, including food that appeared to have been reheated and certain foods that was recycled for use in other meals. Our client also reports that staff did not wear protective gloves when handling food. Meat and fish products also appeared to be partially cooked and reheated, the claimant noted there were lots of flies around the eating areas, as well as the buffet style food being left uncovered for extended periods of time.

However, the poor hygiene standards were not confined solely to the restaurant as our client reports that the bathroom in their hotel suite was very dirty and in a poor state of repair.

On this occasion our expert Travel Law team managed to secure a total of £2,400 in compensation for our client.

£3,200 Holiday Illness Compensation Awarded

Image of clear blue sea and white sandy beach in the Dominican Republic

Our team of dedicated Holiday Illness solicitors were recently instructed by a client who fell victim to the increasingly common cost cutting practices of tour operators whist holidaying in the Dominican Republic.

5* Resort

Our client booked a two week stay at the 5* Grand Palladium Palace Resort Spa & Casino in the resort of Punta Cana, with tour operators Thomson.

Unfortunately, not long into her stay at the 5* resort, our client began to suffer symptoms associated with bacterial gastroenteritis or food poisoning. She complained of suffering stomach cramps, diarrhoea and vomiting, which lasted for a total of four weeks.

Poor food & hygiene standards

As the luxury holiday was booked as an all-inclusive package, the claimant ate at the restaurants within the hotel throughout their stay. However, according to our client, the food and hygiene levels within those restaurants were not of a five star standard.

Our client reports buffet style food left tepid in temperature, not monitored by staff and food that was left uncovered for extended periods of time. They claim that meat and fish served to guests appeared partially cooked and on one occasion they were served visibly raw chicken.

Our client adds that no protective gloves or hats were worn by catering staff and that they often witnessed hot food being added to trays of cold food. Furthermore, the claimant reports that drinks appeared to be watered down and that they believe the ice cubes served in drinks were made using local tap water.

Our expert Travel Law team secured a total of £3,200 compensation for our client on this occasion.

Head of Holiday Illness & Injury here at Hampson Hughes, Shiamli Mehta-Cronie, said:

“Holiday illness is distressing but unfortunately not uncommon. I am acting for hundreds of holidaymakers who have also experienced illness abroad.

“In the majority of cases the problem is down to substandard food hygiene at hotels, an issue which can leave British tourists wishing they hadn’t bothered travelling at all.

“However, legal action can be taken if you feel more could have been done to prevent your becoming ill. The Package Travel Regulations protect holidaymakers who book package holidays through reputable tour operators such as Thomson, First Choice and Thomas Cook.

“If this applies to you then we’d encourage you to get in touch. Suffering with diarrhoea and vomiting as a result of poor hygiene whilst on holiday is simply unacceptable and action can be taken.”
